By answering the questions on this form page, a fully completed and ready for filing Petition for Dissolution or Complaint for Uncontested Divorce, Separation Agreement and, if desired a Shared Parenting Agreement, along with the Judgment Entry granting the Dissolution or Uncontested Divorce (which will be presented to the judge at the time of the final hearing) will be prepared and sent to you together with step-by-step instructions for filing the papers in Ohio.

Court filing fees are not included in the cost of the kit. You will have to pay your county's filing fees when you file the papers. Each county has different filing fees.

Please note: We can not guaranty that the court will approve a deviation in the amount of child support that should be paid or no child support being paid even if both parents agree on it. Usually, however, if the parties agree and there is sufficient income for both parents to provide for the children, the court will approve it. If you want a deviation from the amount the guidelines say should be paid, we will prepare the forms with the proper language and provisions, but we can not guaranty approval by the court.

NOTICE: If you have minor children, you are required to file an additional form called the Child Custody Affidavit form required under the Uniform Child Custody Jurisdiction Act (UCCJA). We will send you a blank copy of the form which you will need to fill out. The form will ask you information about where the children have lived for the last five years and whether there have been any custody proceedings involving the children.

PROPERTY & DEBTS

Separate property is ordinarily defined as that property (i.e., assets and debts) you and/or your spouse had before marriage, acquired after separation or received during the marriage by way of gift or inheritance.

Marital property is ordinarily defined as that property (including assets and debts) that you and/or your spouse acquired after the marriage but before the parties separated.

Pensions and 401(k) If you have pensions and/or 401(k)s that are going to be divided, you will need to have a Qualified Domestic Relations Order ("QDRO") prepared. The cost of the QDRO is not included in the cost of the dissolution or uncontested divorce kit.

Please list all marital and separate property below in the box of who will take possession of each item after the dissolution or divorce. You may list anything here that you wish for the court to have jurisdiction over in the event there is a question later. If you don't care who will get the toaster and iron, etc., you do not need to list it. The purpose of this area is to create a definitive list in the event it becomes an issue at some point.
